The trade name of Blye Group. Where these Terms and Conditions refer to BlyeLove, Blye Group is meant.

Consumer
A natural person acting for purposes outside their trade, business, craft or profession.

Any person who places an order or enters into an agreement with BlyeLove.

Distance contract
A contract concluded between BlyeLove and the customer via the Website.

All goods offered via BlyeLove.nl, including sex dolls, accessories and care products.

Custom made product
Products assembled or manufactured according to the customer’s specifications or choices, or products that are not in stock and are therefore ordered or manufactured specifically for the customer.

Article 3 Applicability
- These Terms and Conditions apply to every offer made by BlyeLove and to every distance contract concluded between BlyeLove and the Customer.
- Before the contract is concluded, the text of these Terms and Conditions will be made available via the Website. Upon request, we can send them by e-mail.
- If additional terms apply alongside these Terms and Conditions and there is a conflict, the provision most favourable to the Consumer will prevail, to the extent permitted by law.
Article 4 Age restriction
- Our products are intended exclusively for persons aged 18 and over.
- If you are under 18, you must leave this Website immediately.
- We reserve the right to request age verification if necessary.
Article 5 Offer and product information
- The offer contains a description of the Products as complete as possible.
- Images are intended to be as accurate as possible. Colours may vary depending on your screen.
- Sex dolls are largely finished by hand. Subtle differences may occur in make-up, hair, skin tone, texture and finishing compared to example photos or showroom models. Such minor deviations do not affect normal use and do not, by themselves, constitute a defect.
- Obvious mistakes or errors do not bind BlyeLove.
Article 6 Formation of the contract
- The contract is concluded when the Customer accepts the offer and completes the order process.
- After placing an order, the Customer will receive an order confirmation by e-mail.
- BlyeLove may refuse an order or attach special conditions to its execution if there is a valid reason, for example incomplete details, suspected fraud or delivery limitations.
Article 7 Prices and payments
- All prices include VAT unless stated otherwise.
- Payments are processed via external payment providers. Available payment methods may vary by country and order.
- The Customer is responsible for entering correct billing and shipping details.
- Unjustified chargebacks may lead to an investigation, administration costs and collection costs, to the extent permitted by law.
Article 8 Delivery and shipping
- Orders are packaged discreetly and shipped via recognised carriers.
- Stated delivery times are indicative and are not strict deadlines.
- If delivery is delayed, we will inform the Customer as soon as possible.
- The risk of loss or damage passes to the Consumer at the moment of delivery to the Consumer or to a person designated by the Consumer who is not the carrier, unless the Consumer chooses a carrier not offered by us.
- If an incorrect address is provided, delivery may fail. Any additional costs arising from this may be charged to the Customer.
Article 9 Cancellation and changes
- As long as an order has not yet been processed or shipped, the Customer may contact us to request cancellation or changes.
- If an order has already been processed, specially ordered from the manufacturer or shipped, cancellation or changes may be limited or no longer possible. This applies in particular to custom made and out of stock Products.
Article 10 Right of withdrawal for Consumers
- In principle, the Consumer may withdraw from the purchase of a Product within 14 days without giving any reason, unless an exception applies.
- The withdrawal period starts on the day after the Consumer, or a third party designated by the Consumer who is not the carrier, receives the Product.
- During the withdrawal period, the Consumer must handle the Product and packaging with care. The Product may only be unpacked and inspected to the extent necessary to establish its nature, characteristics and functioning, as would be permitted in a physical store.
- If the Consumer exercises the right of withdrawal, the Consumer must notify BlyeLove within the withdrawal period in an unambiguous manner, for example by e-mail to info@blyelove.com.
- After notification, the Consumer must return the Product as soon as possible and in any event within 14 days, in accordance with BlyeLove’s return instructions, unless we offer to collect the Product.
- The Consumer bears the direct costs of returning the Product unless we have stated otherwise in advance.
- We will refund all payments received from the Consumer without undue delay and no later than 14 days after the withdrawal notification. We may withhold the refund until we have received the Product back or until the Consumer has provided evidence that the Product has been returned, whichever occurs first. Refunds will be made using the same payment method unless otherwise agreed.
Article 11 Exclusion of the right of withdrawal
- BlyeLove may exclude Products from the right of withdrawal only if this is clearly stated in the offer or otherwise in good time before the contract is concluded.
- Exclusions may apply, among others, to products made to the Consumer’s specifications or specially ordered or manufactured for the Customer, including all sex dolls that are not in stock and are therefore ordered or manufactured specifically for the Customer.
- Exclusions may also apply to products that are not suitable for return for reasons of health protection or hygiene once the packaging has been opened after delivery, including hygiene products and certain accessories, where applicable.
- If the right of withdrawal is excluded, this will be clearly indicated on the product page or during the checkout process.
Article 12 Warranty, defects and reporting
- BlyeLove supplies Products that conform to the contract and meet reasonable standards of quality.
- Please report shipping damage or visible defects as soon as possible after delivery with clear photos or videos so we can assess the issue and, if necessary, report it to the carrier. This request does not limit your statutory rights.
- Damage caused by improper use, incorrect assembly, insufficient maintenance or normal wear and tear is not covered by warranty.
- Minor cosmetic imperfections within normal product tolerances may fall outside warranty coverage.
- Warranty handling may require the Customer to return the Product following prior registration and instructions from BlyeLove.
Article 13 Liability
- BlyeLove is liable for damage only to the extent permitted by law.
- Liability is not excluded in cases of intent or gross negligence, or where the law requires otherwise.
- BlyeLove is not liable for indirect damage, consequential damage or loss of profit, to the extent permitted by law.
Article 14 Intellectual property
- All content on BlyeLove.nl, including texts, photos, product images and branding, is the property of Blye Group or its rights holders.
- Copying, storing, distributing or any other use without prior written consent is not permitted.
Article 15 Privacy and data protection
- BlyeLove processes personal data in accordance with the privacy policy on the Website.
- We share data only with parties necessary to perform the contract, such as payment providers and carriers, or where we are legally required to do so.
- We do not sell personal data to third parties.
Article 16 Complaints procedure
- Complaints about the performance of the contract can be submitted to info@blyelove.com.
- Please describe the complaint as clearly as possible and include photos or order details where relevant.
- We will respond as soon as possible and no later than 14 days after receipt. If more time is needed, we will send an acknowledgement within 14 days with an indication of when a substantive response can be expected.
Article 17 Governing law and disputes
- These Terms and Conditions and contracts between BlyeLove and the Customer are governed by Dutch law, insofar as this does not limit mandatory consumer protection in the Consumer’s country of residence.
- Disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
Article 18 Amendments
- BlyeLove may amend these Terms and Conditions.
- The most recent version will be published on the Website. By continuing to use the Website or placing an order, the Customer agrees to the latest version.
